Is Labour Day a holiday in Germany? ›

Labor Day which is also known as International Worker's Day is an official holiday in Germany since 1933. However, the holiday has been celebrated by German workers for many decades before that. This is a day that celebrates workers and their contribution to society.

In Germany, sec. 11 BUrlG provides that holiday pay is calculated based on a worker's average remuneration payments during the 13 weeks preceding his leave. If a worker has not yet been employed for 13 weeks, the average remuneration paid to date will be used as the basis for the calculation of holiday pay.

As a public holiday in Germany, 1 May is known as Tag der Arbeit or German Labour Day. In many parts of the world, Labo(u)r Day commemorates workers of all nations fighting for the privilege of working (only!) 8 hours a day in the 19th century.

Holiday leave in Germany

Full-time employees in Germany are entitled to a statutory minimum of 20 days of paid holiday per year, based on a five-day working week, or 25, based on a six-day working week. Part-time employees have their holiday leave calculated pro rata, based on their weekly working hours.

Besides German Unity Day, holidays in Germany are determined by the federal states. However, if a German holiday falls on a weekend, the holiday doesn't typically transfer to a weekday. Many businesses – but not police stations or hospitals – close during national holidays in German and regional public holidays.

Turkey has the most federal holidays of any country in the world. There are 16 federal holidays in Turkey every year. There are several other countries that have a double-digit number of holidays. For example, the Netherlands has 11 federal holidays every year.

Work on Sundays and public holidays is generally prohibited. There are exceptions available for workers in the service industry. However, work on Sundays has to be compensated for by corresponding time off within the next two weeks (or eight weeks in the case of work on public holidays).

Although German compensation laws do not require a 13th-month bonus, many employers choose to give employees an extra month's wage at the end of the year.

Holiday Leave in Germany

Employees are entitled to a minimum of 24 days off for a 6-day work week and 20 days for a 5-day one. In reality, most employees receive 25-30 days of leave, even on a 5-day workweek. Employers may provide additional leave to employees who perform intense or dangerous work.

Naturally, the hours worked in Germany vary depending on whether you work full-time or part-time. An average working week in Germany as a full-time employee is between 36 and 40 hours, with daily working weeks in Germany between seven and eight hours five days a week.

May 1 marks a public holiday in all of the nation's states. Not only are many businesses closed on that day, but so are all banks and post offices. While the majority of German shops are closed on the day, those in areas with many tourists sometimes remain open.

This is due to the Ladenschlussgesetz or "Store-closing law," which forbid stores from operating on Sundays. The Ladenschlussgesetz was put into effect in 1956 in former West Germany. The law stayed this way with only minor revisions until 2006.

Labor laws and Labor Day
